Work-Made-For-Hire Writing: Five Reasons Writers Should Do It

Over the years I've written several articles about Work Made for Hire contracts (follow this link to see some of them). Many writers run away from such work and refuse it. These people believe they are protecting their rights and want to publish royalty projects instead of selling all their rights to someone else.
 
My literary attorney has told me that I've signed more Work Made for Hire agreements than anyone she knows. I've also been a working writer in the publishing community for decades. The truth is sometimes it is better to earn the money upfront from a publisher rather than hope for royalties (which may or may not happen).
 
In this article, I want to give five reasons to write Work Made For Hire projects. I call them projects because they are not always books. Sometimes they are articles or white papers or any number of other types of writing. 
 
1. You Get Immediate Work. Often in the publishing world, you have to write your article or book with the hope that you will find someone to publish it. With Work Made For Hire, you have found paying writing work which you can do right away—and get payment.
 
2. You Get Paid for Your Work. Depending on what you negotiate in a Work Made For Hire agreement, often you get half of the money upfront. This fact helps your cash flow as a writer—especially those of us who write full-time.
 
3. You Can Build Your Reputation and Get a Writing Credit. Some Work Made For Hire is ghostwriting (no credit). On other occasions, my writing is credited. Sometimes this work appears in the tiny print on the copyright page. Other times my name appears on the title page of the book and not the cover. On other books where I've co-authored the book for someone else, my name appears on the cover as “with W. Terry Whalin.” To the publishing world, this “with” credit indicates I wrote the book. If you are new in the publishing world, this credit can be an important part of building your reputation in the publishing world.
 
Several of the children's books that I have published were Work Made For Hire. The finished children's books had high quality illustrations and were a beautiful finished product. In some cases my name only appears on the copyright line (small print) but in other cases, my name appears on the cover. How it turns out for you is all about watching the details of the agreement. Several of my devotional books which I wrote as a Work Made For Hire have sold over 60,000 copies (which is a great credit for any writer—and something I use from time to time). 
 
4. Provides A Way to Work for a Publisher. For many new writers, it's a challenge to publish with traditional publishers for your own work. Sometimes publishers need a writer to complete a manuscript in a short amount of time. Years ago I wrote a book for a publisher in a short amount of time and exceeded their deadline. My name is in the small print on the cover of this book and it continues to sell. When I checked a few years ago, this book had sold over 100,000 copies. As the other examples in this article, I wrote this book as a work made for hire and haven't been paid anything additional but it is a great credit for a writer.
 
5. In a hard environment, provides a way to seize an opportunity. I know some publishers are making cautious decisions about what to publish (for a number of reasons including the pandemic). This caution has made it hard for writers. Work Made For Hire is writing that will always be needed and is a way for you to seize the opportunity, get published and get paid. Where Is Your Tipping Point?

How do you find your tipping point in book publishing? Or to ask it a slightly different way: what elements have to come together for  book to become a bestseller? One of the critical elements in my view is great writing and storytelling. Good writing helps people spread the word or buzz about the book (word of mouth).  Yet some wonderfully written books don’t get to the bestseller list.

Several years ago, I was interviewing Jerry B. Jenkins for a story related to one of the Left Behind books. Jerry realizes the unusual way his series of books has caught public attention—with over 60 million copies in print and a huge appetite for the concept which continues today with about 10,000 units of the first book continuing to be sold. Jerry wrote the first book in 1995.

Jerry recommended that I read a book from Malcolm Gladwell called The Tipping Point, How Little Things Can Make a Big Difference (Little, Brown Company, 2000). A tipping point according to Gladwell is that magical moment when an idea, trend, or social behavior crosses a threshold, tips and spreads like wildfire. What causes it?  

The Law of the Few is one of the critical elements where three groups intersect and come together. These three factors are: connectors, mavens, and salesmen. A connector is someone who knows lots of people and Gladwell gives a simple test. He takes about 250 surnames from the Manhattan phone book. You are to scan the names and see if you know someone with that last name. As he says on page 41, “All told, I have given the test to about 400 people. Of those, there were two dozen or so scores under 20, eight over 90, and four more over 100…Sprinkled among every walk of life, in other words, are a handful of people with a truly extraordinary knack of making friends and acquaintances. They are Connectors.”

A Maven is one who accumulates knowledge. “A Maven is a person who has information on lots of different products or prices or places. This person likes to initiate discussions with consumers and respond to requests.” (p. 62) So you see two of the elements—mavens and connectors.

“In a social epidemic, Mavens are data banks. They provide the message. Connectors are social glue: they spread it. But there is also a select group of people—Salesmen—with the skills to persuade us when we are unconvinced of what we are hearing, and they are as critical to the tipping of word-of-mouth epidemics as the other two groups.” (p. 70).

Do I have it figured out? Not at all. I believe Gladwell is on to something significant for these factors to come together to tip the balance and make a book move from one level to the bestseller category. I hope it provides you with a bit of my insight. I still have a great deal to learn about this particular question.

You Need a Mixture of Marketing Efforts

How is your writing selling? It's an old sales adage: If your books (or any writing) isn't selling, you need to be touching more people (asking for the sale) or creating new writing.  Your audience doesn't increase or your books don't sell without continued effort from you as the author. 

Whether you work with a traditional publisher who sells your book into the bookstores or you self-publish and are on your own, you still need to be reaching more people with your work. As an acquisitions editor, I tell every author that it is 80% up to them to sell more books. Yes we can sell the books into the bookstore but unless the author is building buzz and telling others about the book, those books in the bookstore will be returned to the publisher.

I wish I could tell you there is one path or one formula to sell books and become a bestseller. If such a formula existed, then every book would be a bestseller—and that is just not the case. Some books that are poorly written hit the bestseller list while other well-crafted titles sell a modest number of copies. The average self-published book sells about 200 copies during the lifetime of the book. The average traditional book sells around 1,000 copies. Now each of us want to beat these averages so how do we do it? It's through a mixture of different marketing efforts.


One of the most knowledgeable people that I know in this area is Rick Frishman. For over ten years, Rick has been our publisher at Morgan James Publishing. He has a huge list of bestselling authors that he has worked with like Jack Canfield, Mark Victor Hansen, Stephen King and Mitch Albom.
